Liability Waiver Agreement
In consideration of being allowed to enter the activities area and/or participate in any party and/or program affiliated with The Laboratory Collective without respect to location, the undersigned, on his or her behalf, and on the behalf of the participant(s) identified below, acknowledges and agrees to the following conditions:
I represent that I am the parent or legal guardian of the participant(s) named above, or I have obtained permission from the parent/legal guardian of the participant(s) named above (the undersigned and participants each being referred to as a “user”) to execute this agreement on their behalf.
I agree that the participant(s) named above and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as condition while participating in any program at The Laboratory Collective.
The Laboratory Collective may revoke any user’s permission to access and use of The Laboratory at any time hereafter in the event the participant fails to follow such terms, signs, rules and instructions.
In addition, if I observe any hazard during our participation, I will bring it to the attention of the nearest The Laboratory Collective employee or official immediately.
I AGREE to follow all rules and regulations of The Laboratory Collective (the “Company”) while in or about the premises or while using or observing the premises or any facilities or equipment, or participating in any program affiliated with The Laboratory Collective without respect to location, and understand and agree that I may be expelled at any time, with no refund of any monies paid, for failure to abide by such rules and regulations.
This agreement applies to all past, present, and future visits to any The Laboratory Collective facility. I agree to the following conditions with respect to being permitted to utilize the facilities, services, and programs of The Laboratory Collective for any purpose, including, but not limited to: use of facilities or materials, participation in any program or class affiliated with The Laboratory Collective regardless of location, or observation.
I understand that activities at the facility, including participation in programs or classes, can involve materials or movements that create risk. I hereby assume full responsibility for and risk of bodily injury, property damage or loss, regardless of severity, that I or my minor child may sustain from my or my minor child’s presence in, upon, or about the facility or while participating or observing the premises or any facilities, or participating in any program affiliated with The Laboratory Collective without respect to location.
I, for myself, my spouse, and my minor child, hereby fully release, waive, discharge, and covenant, not to sue The Laboratory Collective, its operating centers, their respective owners, officers, directors, Board of Managers, Trustees, members, volunteers, employees or agents (the “Released”) and each of them from any and all claims for injuries, damages or loss that I or my minor child may have or which may accumulate to me or my minor child from my and/or my minor child’s presence in, upon, or about the facility or while participating or observing the premises or any facilities, or participating in any program affiliated with The Laboratory Collective without respect as to location.
I hereby agree, on behalf of myself, my spouse, and my child, to indemnify and save and hold harmless the Released and each of them from any loss, liability, damage or cost they may incur from my or my minor child’s presence in, upon, or about the facility or while participating or observing the premises or any facilities, or participating in any program affiliated with The Laboratory Collective without respect as to location.
I recognize that Corona Virus or COVID-19 is an extremely contagious virus that spreads easily through airborne and droplet transmission and person-to person contact and may be transmitted by individuals having no apparent symptoms of infection. Federal and state authorities recommend social distancing as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in The Laboratory Collective programs or activities could increase the risk of contracting COVID-19.
I, for myself and Minor, agree to comply with the rules and guidelines (“Guidelines”) adopted by The Laboratory Collective relating to COVID-19 while participating in The Laboratory Collective programs and activities.
To the fullest extent permitted by law, user, on behalf of his/her self, and each user’s heirs, executors, administrators, legal representatives and assigns, fully and forever waives, releases and discharges landlord and its managers, partners, members, owners, officers, directors, employees, contractors, agents, affiliates, successors and assigns (collectively, the “facility affiliates”) from any and all claims, damages, liabilities, losses, demands, rights of action, causes of action, costs and expenses, of any kind or nature whatsoever, present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of a users attendance at or use of The Laboratory, whether due to negligence of The Laboratory Collective or any of the its employees.
Further, user releases and discharges The Laboratory Collective and its employees from any and all liability for any loss, theft of, or damage to personal property of the users. I acknowledge that The Laboratory Collective and the owners, directors, officers, volunteers, representatives, and agents are not responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of The Laboratory Collective.
I further expressly agree that the foregoing assumption of risk, release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of Illinois and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
In the event of an emergency, I authorize The Laboratory Collective staff to secure treatment from any licensed hospital, physician, or medical personnel deemed necessary for my or my child’s immediate care, and agree that I will be responsible for the payment of all medical services delivered.
All participants agree that any photography or video taken while participating in a class, special event, or in the facility may be used for promotional purposes for The Laboratory Collective.
All participants accept full responsibility for the care of the equipment affiliated with The Laboratory Collective without respect of location and agree that they will be responsible for the replacement at full retail value of any equipment damaged or not returned.
The Laboratory Collective reserves the sole and exclusive right to decline participation to anyone for any reason not prohibited by law.
The Laboratory Collective also reserves the right to remove any child or guardian for disruptive and/or inappropriate conduct at the sole discretion of The Laboratory Collective.
I, the undersigned, have read and voluntarily signed this assumption of risk, release, waiver and indemnity agreement. I further agree that no oral representations, statements or inducements apart from the foregoing written agreement have been made.
The undersigned, on behalf of his/her self, acknowledges that he/she is aware of the risks and hazards inherent in the participation in activities at The Laboratory Collective, and that participation in activities could cause injury (both known and unknown) to the participant.
As a material consideration for the participant to have access to The Laboratory Collective, the undersigned acknowledges that use of The Laboratory Collective facilities shall be at the users’ own risk and that the undersigned, on behalf of his/her self and on behalf of the participants hereby elects voluntarily to access and use The Laboratory Collective and to voluntarily assume full responsibility for all risk of personal injury, death, property damage or other loss that may be sustained by the users that may result from or arise out of access to The Laboratory Collective.
